Terms of Use

These Terms of Use are an agreement between you and B.I.D.E. — Band Instrument Discovery Experience ("B.I.D.E.", "we", "us"). By using this site or submitting a registration, you agree to these terms. If you do not agree, please do not use the site.

You must be at least 18 years old and the parent or legal guardian of the student named to submit a registration.

B.I.D.E. — Band Instrument Discovery Experience is an independently developed and owned music education program. The B.I.D.E. name, logo, branding, slogans, curriculum, teaching framework, lesson plans, instructional and recruiting materials, forms, and all text, images, and code on this website are owned by the program's founder and protected by copyright, trademark, and other laws.

No school, school division, employer, or partner owns the program or its materials. Hosting the program, promoting it, or providing a facility for it does not transfer any ownership, license, or right in the program beyond what is expressly granted in writing.

Except for the limited permission described in section 4, no license to the program or its materials is granted by this site.

School names, mascots, and logos appearing on this site remain the property of those schools and are used with their permission solely to identify the program's host and partner locations. Their appearance does not imply that a school owns, endorses beyond its host role, or is responsible for the program.

You may view this site and use the registration form for its intended purpose of registering a student, and print or save a copy of pages for your own personal, non-commercial reference. All other rights are reserved.

You agree not to:

• Copy, republish, resell, license, or create derivative works from the program name, logo, curriculum, materials, or site content without our written permission
• Use the program name or logo in a way that implies ownership, sponsorship, or affiliation you do not have
• Scrape, harvest, or bulk-download content or submissions
• Submit false, misleading, or another person's information
• Attempt to gain unauthorized access to the site, its database, or its email systems, or otherwise interfere with its operation
• Use the site for any unlawful purpose

By submitting the registration form you confirm that you are the parent or legal guardian of the student named, that you are authorized to submit the registration, that the information you provide is accurate and complete, and that you have read the Privacy Policy.

You grant us permission to use the information you submit to operate the program: to register and place the student, plan instruments and staffing, provide accommodations, and communicate with you. We handle it as described in the Privacy Policy.

Submitting the form is a request to participate. Participation is confirmed by the program and may be limited by space, instrument availability, or host school requirements. Event dates, times, locations, staffing, and program details may change.

The registration form records your photography permission choice for B.I.D.E. program photographs, and the program honors that choice. Any photography taken or published by a school is separately governed by that school's own media policy. You may change or withdraw your choice by emailing bideacademy@gmail.com.

This site may link to school or third-party websites. We do not control them and are not responsible for their content, policies, or practices.

Our Privacy Policy explains what we collect and how we use it, and is part of these terms.

This site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted, secure, or error free, or that information on it is complete or current.

To the fullest extent permitted by law, B.I.D.E. and its founder, staff, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or lost opportunity, arising out of your use of this site. Our total liability for any claim relating to this site is limited to one hundred dollars (US$100). Nothing in these terms limits liability that cannot be limited by law.

You agree to indemnify and hold harmless B.I.D.E. and its founder, staff, and volunteers from any claim, loss, or expense arising out of your misuse of this site, your breach of these terms, or information you submit that is false or that you were not authorized to provide.

These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Virginia Beach, Virginia, and you consent to their jurisdiction.

If any provision of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between you and us about this site. You may not assign these terms; we may assign them in connection with a transfer of the program.

We may update these terms. The updated version will be posted on this page with a new effective date, and it applies to use of the site after that date.
